Participation Agreement, Liability Waiver, and Hold Harmless Agreement

I, the undersigned, in my capacity as a participating adult and as the parent or legal guardian of the participating child(ren) indicated above (each, a “Participant” and collectively, the “Participants”), acknowledge and agree to the terms and conditions set forth herein in consideration for the participation of both myself and the Participants in the activities provided by JJ’s Kid Zone, located at 1F North Oaks Plaza St. Louis MO 63121:

1. Scope of Agreement: This agreement applies to all adults and children who participate in any activities or utilize any facilities at JJ’s Kid Zone.
2. Activities: Activities refer to all services and activities offered by JJ’s Kid Zone.
3. Supervision: I acknowledge that while JJ’s Kid Zone staff are present, they are not responsible for direct supervision of Participants. It is my obligation to oversee any minors that I accompany to the facility.
4. Safety Rules: I, along with the Participants, comprehend and agree to adhere to the safety rules and play guidelines that are displayed throughout the playground and on the website, www.jjskidzone.com. I acknowledge that these rules may be subject to change, and I have acquainted myself and the Participants with them before entering the play area.
5. Socks: I understand and agree that all Participants and any accompanying adults, including myself, are required to wear socks within the facility for reasons of hygiene and safety. I acknowledge that these socks are available for purchase at the facility, and it is my responsibility to ensure that all Participants and accompanying adults are wearing them.
6. COVID-19 Warning: An inherent risk of exposure to COVID-19 exists in public places. By visiting JJ’s Kid Zone, I voluntarily assume all risks related to COVID-19 exposure. I agree to abide by any health and safety measures implemented by JJ’s Kid Zone to prevent the spread of COVID-19.
7. Assumption of Risk: I understand that participation in the Activities carries potential risks, which may include minor injuries (such as scratches, bruises, and sprains), major injuries (such as eye injury, joint or back injuries, and concussions), and catastrophic injuries (including paralysis and death). I acknowledge that JJ’s Kid Zone cannot eliminate all risks or ensure complete safety. I assume these risks willingly on behalf of myself and my minor Participant child.
8. Release and Waiver of Liability: For myself and any minor Participant child, I release and discharge JJ’s Kid Zone, its managers, members, employees, and agents from any liability for sickness, injury, or death arising from participation in the Activities. This release encompasses all claims, including those arising from JJ’s Kid Zone’s negligence or any other breach of legal duty.
9. Indemnification and Hold Harmless: I agree to indemnify JJ’s Kid Zone and hold it harmless from all costs, including attorney’s fees, resulting from claims brought as a result of my or my minor Participant child’s involvement in the Activities.
10. Security Cameras: I acknowledge that security cameras are installed at JJ’s Kid Zone’s facility for safety purposes and may be referenced if any incidents occur.
11. Photo Release: Unless I inform JJ’s Kid Zone in writing to the contrary, I grant JJ’s Kid Zone permission to use any photographs, video, or sound clips of me or any minor Participant child for any lawful purpose, including publicity, advertisement, and web content, without payment of any royalty or compensation.
12. Parent or Legal Guardian Certification and Consent: I certify that I am the parent or legal guardian of the minor Participant(s), and I have the authority to waive rights on their behalf. I understand the risks of the Activities and voluntarily sign this document. This Agreement has no expiration date.
13. Jurisdiction and Venue: This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri. Any disputes arising from this Agreement shall be resolved in the courts of Missouri.
14. Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
